HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU RP No. 73/2024 in LPA No. 91/2020 Mohan Lal .....Applicant(s)/Petitioner(s) Through :- Mr. Ayushman Kotwal, Advocate v/s UT of J & K & Ors. .....Respondent(s) Through :- Mr. P D Singh, Dy. AG Mr. S S Ahmed, Advocate CORAM: HON’BLE MR. JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE SANJAY PARIHAR, JUDGE ORDER 12.08.2025 CM No. 6107/2025 1. This is an application filed by the petitioner seeking condonation of 143 days delay in filing the review petition against the judgment dated 19.04.2024 passed in case titled UT of J & K & Ors. Vs. Mohan Lal & Anr. 2. For the reasons stated in the application coupled with the submissions made at Bar, the application is allowed and the delay of 143 days in filing the review petition is, accordingly, condoned. RP No. 73/2024 1. This review petition seeks recall of an order and judgment dated 19.04.2024 passed by this Court in LPA No. 91/2020. The judgment is sought to be recalled through the medium of the instant petition, primarily on the ground that this Court while disposing the appeal (supra) did not take into consideration that after 2014 the Sr. No. 17 2 RP No. 73/2024 in LPA No. 91/2020 petitioner was not even in the service of Fisheries Department and, therefore, could have been held entitled to the notional benefit of appointment from the said date. 2. Having gone through the judgment sought to be reviewed, we are of the considered opinion that the aforesaid aspect has escaped the attention of this Court and, therefore, the judgment rendered to the aforesaid extent suffers from an error apparent on the face of record. 3. This review petition, therefore, is allowed and the judgment dated 19.04.2024 to the extent aforementioned alone is recalled. 4. Let the appeal being LPA No. 91/2020 come up for consideration on the aforesaid aspect of the matter on 15.09.2025. (Sanjay Parihar) (Sanjeev Kumar) Judge Judge JAMMU 12.08.2025 Manan
