The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A6, seeking regular bail, in Crime No.66 of 2023 of Sullurpeta Police Station, Tirupathi District. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) r/w 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short lthe NDPS Act'). I-` 3. case of the prosecutI'On, in brief, js that, on 23.05.2023, on recel'pt of credible information, the sub-Inspector of police along with his staff and mediators rushed at the outskjr{s of Gayathri Nagar, Kothapoluru Road, sullurpet and found A1, A2 and A7 to A12 in possessI-On Of 4 Kgs of Ganja. The contraband along with other material was seized under the cover of medI®atOrS report. 4. Heard. perusedtherecord. 5. on perusal of the material on record goesto showthat basing on the confessional statements of co-accused, name of the petI-tiOner herein/A6 js arrayed as accused in the present crime. ln pursuant to the confessional statement, the petl'tioner herein was arrested on p.T. Warrant on 10.12.2024. Except the confessional statement, there js no other material is collected showing the compII-CI-ty Of the petjtjoner in the present crl'me. The quantity of contraband allegedly seized from the possession of the accused is 4 Kgs of ganja, which I-S not a commercial quantity. Learned Assistant public Prosecutor submitted that major portion of investigatl-on has been completed. 6. ln view of the aforesaid facts and circumstances of the case, this court is inclined to grant bail to the pet,-tl-oner/A6 on the followl-ng conditions. i) The petitioner/A6 sha" be released on ba" on hI'S executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two --=L'EiZ- E sureties of the like sum each to the satisfaction of the learned I Add-ltional District and Sessions Judge-Gum-Special Judge for Trial of Offences under NDPS Act, Nellore. ii) on release, the petitioner shall appear before the Station House officer concerned, once in a week'-i.e., on every saturday between 10.00 am and o1.00 pm, t'lll filing of the charge Sheet. 7.
