SREENIVASA REDDY RIMINAL ORDER : This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the Petitioner/Accused, seeking regular ba" in crime No.514 of 2024 of KancharaPalem Police station, visakhapatnam commissionerate. 2, A case has been registered against the Petitioner herein for the offence punishable under section 109(1) and 79 of the Bharatiya Nyaya Sanhita. 3, Case of the Prosecution, in brief, iS that, On 29.12.2024 in evening hours, while the son of the defacto complainant by name Thanay Sat outside the house, her brother--ln-Iawls son by name Munish hit her son with stone. on 30.12.2024 at about 6.00 p.m., the defactO COmPlainant Was at her house along with her ch'Ildren. ln the absence Of her husband, the petitioner/accused came to her house with an intention to kill her, the petitioner/accused picked up a nearby flowerpot and hit her, and that she susta'lned injuries. At that time, father-in-law Of the defactO comPlainant obstructed the petitioner/accused and by that time also the petitioner/accused threatened the defacto complainant and her family that he would kill them. I.`_- r/ Heard. perused the record. 5. A perusal of the material available on record goes to show that the petjtI'Oner had an altercation with the defacto complajnant on 30.12.2024. ln the absence of the husband of the defacto complal-nant, the petitioner herel-n entered the house of the defacto complaI-nant, took a flowerpot, and trI'ed tO hl-I on the head of the defacto complajnant. The defacto complainant dl'd not sustain any injurl'es. At that point, the petjtjoner was pacified by father-I-n-law of the defacto complainant and was taken away. The petI-tiOner/accused was arrested on 31.12,2024, and since then he has been in judicl'al remand. 6. The learned Assistant public prosecutor, appearing on behalf of the state, submits that sI-X Cases have been registered against the petitioner herein, and a rowdy sheet has also been opened against him- ln the present case, the defacto complainant dI-d not Sustain any inJ-urieS, and the petitioner has been in judicl-al remand for 35 days. 7. In view of the aforesaid facts and circumstances of the case, this Court I-s inclined to grant bail to the petitioner/Accused on the following conditions. i) The petitioner/Accused shall be released on bail on his executl'ng Personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with A,, faEffi J I/ two sureties of the like sum each to'the sat.lsfact'lon of the learned sessions Judge, Manila Court, VisakhaPatnam. ill) on release, the petitioner shall appear before the stat®IOn House officer concerned, every day between 10.00 am and 01.OO pm, till filing Of the charge sheet. 8.
