Heard Mr. C. Jayant K. Rao, Mr. Kaushal Yadav, and Mr. Galib Dwivedi, learned counsels appearing for the respective petitioners and Mr. Sangharsh Pandey, learned Government Advocate, appearing for the State/respondents. 2. Since all these writ petitions raise substantially similar questions of fact and law, they were ordered to be clubbed together. Accordingly, with the consent of learned counsel appearing for the parties, the matters were heard analogously and are being disposed of by this common order, in order to avoid multiplicity of proceedings and to ensure consistency in the adjudication of the issues involved. 3. The petitioners, by way of the present writ petitions, seek a direction for their regularization on the ground of having rendered long and continuous service as Guest Teachers (Vidhya Mitans) in their respective subjects. It is submitted that they have been serving for about four years, including during the COVID-19 pandemic, and they continue to discharge their duties in the respective schools. The petitioners apprehend that, pursuant to the process of regular recruitment, they may be disengaged from service, despite possessing the requisite qualifications. It is further submitted that most of the petitioners have already crossed the 9 upper age limit for applying to regular posts, and any discontinuance at this stage would seriously jeopardize their future prospects. 4. For the purpose of adjudication of all the connected matters, WPS No. 4334/2023 has been taken up as the lead case. The reliefs sought therein are as follows:— “10.1 That, this Hon’ble Court may kindly pleased stay the advertisement issued by the respondent No.2, to the case of the petitioners in the interest of justice. 10.2 That, those applicants whose age is 40 years or above should be considered suitable for these posts. 10.3 That, the compulsion of TET should be abolish for guest teacher as they are already experienced. 10.4 That, this Hon’ble Court may kindly pleased to direct the respondents 1 to 5 not to disrupt the services of the petitioner by replacing them by advertisement issued by the respondents, in the interest of justice. 10.5 Any other relief which this Hon’ble Court may think just and proper may also kindly be allowed in the interest of justice.” 5. The petitioners in all the writ petitions are stated to be working as Guest Teachers (Vidhya Mitans) since the year 2019 and continue to discharge their duties till date. They assert that they possess the requisite educational qualifications for regular appointment, namely, Post-Graduation along with a B.Ed. Degree, which 10 constitutes the minimum qualification prescribed for recruitment to the post of Teacher. The State Government, however, has issued an advertisement dated 04.05.2023 inviting applications for fresh appointments. The grievance of the petitioners is that despite possessing the necessary qualifications, they are not eligible to apply under the said advertisement as most of them have already crossed the upper age limit prescribed for the post. 6. It is further case of the petitioners that the concerned schools and departmental authorities have, from time to time, recommended that the services of the petitioners be continued, as their presence is essential for the proper functioning of the schools. Nevertheless, owing to the age bar, the petitioners are likely to be deprived of an opportunity to participate in the recruitment process. They therefore seek a direction that Guest Teachers (Vidhya Mitans) presently working be granted appropriate age relaxation. They also contend that the requirement of passing the Teacher Eligibility Test (TET) should be relaxed or dispensed with in their case, as they already possess B.Ed. Degree and have gained substantial teaching experience, which, according to them, should suffice for determining eligibility. 7. Mr. C. Jayant K. Rao, Mr. Kaushal Yadav, and Mr. Galib Dwivedi, learned counsel appearing for the respective petitioners, submit that the petitioners were duly appointed after verification of their qualifications and have gained significant teaching experience 11 over the years. They are still serving in the respective schools as Guest Teachers (Vidhya Mitans). It is urged that their services should not be abruptly discontinued merely because the process for regular appointment has been initiated. They further submit that the petitioners will be doubly prejudiced; first, on account of their over-age status, which renders them ineligible to participate in the regular recruitment process, and second, due to the insistence on TET qualification despite their experience and higher degree credentials. They therefore pray that appropriate directions be issued to protect the services of the petitioners and to ensure that they are given a fair and meaningful opportunity for consideration against regular posts. 8. Conversely, Mr. Sangharsh Pandey, learned Government Advocate, submits that the petitioners were appointed purely as Guest Teachers on a stop-gap basis, only to meet the exigencies arising from the shortage of teachers until regular recruitment could be undertaken. With the State Government now having initiated a regular selection process, the services of the petitioners are no longer required. It is contended that the petitioners cannot claim any right to continue in service or seek regularization, nor can they insist upon relaxation of statutory qualifications or age limits. It is further submitted that Guest Teachers are engaged only on a temporary and ad hoc basis, without any vested right or legitimate expectation to be absorbed or to receive preferential 12 treatment in the regular selection process. Hence, no indulgence is warranted in their favour. 9. I have heard learned counsel for the parties at length and have carefully perused the documents and materials placed on record along with the writ petitions. The rival submissions advanced by both sides require examination in light of the applicable recruitment rules, the nature of engagement of Guest Teachers, and the legal principles governing claims for regularization, age relaxation, and relaxation of educational qualifications. 10. It is a settled principle of service jurisprudence that a candidate appointed for a fixed tenure cannot claim continuation or regularization merely on the basis of having served for a certain period, unless there exists a statutory or contractual right to that effect, which is conspicuously absent in the present case. 11. Upon a thoughtful consideration of the submissions advanced on behalf of the parties and on a meticulous examination of the materials placed on record, it is quite vivid that the petitioners were engaged as Guest Teachers (Vidhya Mitans) purely on a temporary and stop-gap basis to meet the immediate shortage of teaching staff. Their engagement was never against sanctioned posts and was not made in accordance with any statutory recruitment rules. Such contractual engagements do not confer any right of regularization or continuation. The Hon’ble Supreme Court has consistently held that temporary, ad hoc, or contractual 13 employees cannot claim absorption or continuance in service as a matter of right. (Secretary, State of Karnataka and others v. Umadevi (3) and others, (2006) 4 SCC 1). 12. In Umadevi (3) (supra), the Supreme Court clarified that the Courts must refrain from issuing directions for regularization or for bypassing the statutory recruitment process, as doing so would violate Articles 14 and 16 of the Constitution. The principles laid down therein have been reiterated in subsequent decisions, including State of Rajasthan and others v. Daya Lal and others, (2011) 2 SCC 429, where it was held that temporary employees cannot seek regularization unless their initial appointment is legal, against sanctioned posts, and in accordance with rules. Similarly, in Official Liquidator v. Dayanand and others, (2008) 10 SCC 1, the Supreme Court emphasized that regularization cannot be used as a mode of entry into public service. 13. With regard to the plea for age relaxation, it is well settled that relaxation of upper age limit is a matter of State policy, and the Courts cannot direct relaxation contrary to the recruitment rules. In P.U. Joshi and others v. Accountant General, Ahmedabad and others, (2003) 2 SCC 632, the Supreme Court held that prescribing qualifications and age limits lies within the exclusive domain of the rule-making authority and Courts cannot interfere unless the rule is unconstitutional. The prayer for grant of 14 preferential treatment in age relaxation for Guest Teachers therefore cannot be accepted. 14. Similarly, the requirement of passing the Teacher Eligibility Test (TET) arises from the statutory framework under the Right of Children to Free and Compulsory Education Act, 2009 and the NCTE guidelines. The Supreme Court, in Pramati Educational and Cultural Trust (Registered) and others v. Union of India and othes, (2014) 8 SCC 1, upheld the mandatory nature of qualifications prescribed by the NCTE. This Court cannot dilute or dispense with TET qualification merely on grounds of experience or higher academic degrees. 15. The plea of legitimate expectation also deserves rejection. The petitioners were aware from inception that their engagement was temporary and would cease once regular recruitment was undertaken. The doctrine of legitimate expectation cannot override statutory rules. This principle has been reiterated in State of Bihar and others v. Bihar Secondary Teachers Struggle Committee, Munger and others, (2019) 18 SCC 301 and Punjab State Electricity Board and others v. Jagjiwan Ram and others, (2009) 3 SCC 661. 16. The Division Bench of this Court while dealing with the similar issue in Writ Appeal No. 729/2014 (Gayatri Sharma v. State of Chhattisgarh and others), decided on 08.11.2024 relying upon 15 the various pronouncements of the Hon’ble Supreme Court, has passed the judgment in following terms :- “13. This Court, in Pinky Gupta & Another v. State of Chhattisgarh & Others, {WA No. 620/2024, decided on 27.09.2024}, wherein the order dated 26.06.2024 passed by the learned Single Judge in WPS No.8073/2023 and connected matters were disposed of in light of the comprehensive policy 2024 dated 20.06.2024 framed by the State Government (the Higher Education Department) vis- a-vis the engagement of Guest Lecturer(s)/Part Time Lecturer(s), had affirmed the order of the learned Single Judge and it was observed that the appointment of Guest Lecturers for the academic session 2024 shall be made strictly in accordance with the policy of 2024. 14. In essence, the appellant/writ petitioner, amongst other reliefs, seeks a relief that she be permitted to continue as Guest Lecturer at Government Dr. Radhabai Naveen Girls College, District Raipur. 15. The appellant/writ petitioner has failed to establish that an ad hoc or temporary appointee cannot be replaced by another ad hoc or temporary appointee and if a temporary appointee in service is incompetent, can he not be allowed to be replaced with a competent or more competent person. There is no reason why the competent person cannot be appointed in place of the incompetent person, when both the appointments are ad hoc or temporary in nature. 16 16. In the present case, the appellant/writ petitioner is also a Guest Lecturer which is a temporary arrangement for one academic session. If the State has come up with a new Policy of 2024 which is in conformity with the UGC guidelines and better candidates would be available for the said posts, it cannot be said to be arbitrary or unreasonable if the State decides to advertise those posts and appoint fresh Guest Lecturers having better and higher qualifications in comparison to the existing ones with lesser qualification. Even otherwise, it is a settled position of law that the Courts cannot interfere with the soundness and wisdom of a policy. A policy is subject to judicial review on the limited grounds of compliance with the fundamental rights and other provisions of the Constitution. The Policy of 2024 would definitely be in the larger interest of the students. 17. We are totally in agreement with the reasons and observations of the learned Single Judge which is just and proper warranting no interference. No relief(s) as sought for by the appellant/writ petitioner can be granted in this appeal as it is for the State to decide what would be the best in the interest of the institution and the students. Even otherwise, the learned Single Judge has made it clear that the appellant/writ petitioner shall not be replaced by similar set of Guest Lecturer having similar qualification as the appellant is having and to that extent, the rights and interest of the appellant/writ petitioner remains secure. 18. As a result, this appeal stands dismissed.” 17 17. Having considered the authoritative pronouncement of the Division Bench of this Court in Gayatri Sharma (supra), it is evident that the engagement of Guest Teachers/Guest Lecturers is purely a temporary and stop-gap arrangement, made only for one academic session or till regular appointments are made. The petitioner, therefore, cannot claim any vested or enforceable right for continuation or re-engagement on the said post. 18. In view of the above settled legal principles, particularly the law laid down by the Division Bench and considering the settled legal position that the scope of judicial review in matters of policy decisions is limited, this Court finds no merit in the present writ petitions. The petitioners’ claims for regularization, age relaxation, or relaxation of TET qualification are contrary to law and established precedents. The recruitment process initiated by the State Government in accordance with statutory norms cannot be interfered with. 19. Accordingly, all the writ petitions being WPS Nos.4781/2023, 4334/2023, 4339/2023 and 4344/2023, stand dismissed. There shall be no order as to costs. Sd/- (Amitendra Kishore Prasad) Judge Yogesh
