JUSTICE DEEPAK ROSHAN --------- For the Petitioner(s) : Mr. Rajeev Ranjan Tiwary, Advocate For the Resp.-JUVNL : Mr. Om Prakash Tiwari, Advocate --------- 2025:JHHC:26396 3 15/Dated:-28.08.2025 The instant writ application has been preferred by the Petitioners praying therein for a direction upon the Respondent Authorities to give employment and appoint these Petitioners, who are land losers/displaced persons and whose land has been taken for construction of Sikidari Hydel Project. 2. Learned counsel for the Petitioners submits that though some of the similarly situated persons have been appointed, but in spite of the said fact the petitioners have not been appointed. Learned counsel further draws attention of this Court towards Annexure-2, wherein a letter has been written to the Deputy Commissioner by the Secretary, the then Jharkhand State Electricity Board that some action is being taken; however learned counsel for the Petitioners could not demonstrate by any chit of paper that there was any agreement between the then Jharkhand State Electricity Board and the land losers to provide the service. 3. The contention of the Petitioners that similarly situated employees were given employment does not make their case better because there is no concept of negative equality. It is an admitted case that there is no R&R Policy with regard to giving job in lieu of land. 4. Learned counsel for the Respondents draws attention of this Court towards supplementary counter affidavit dated 23.08.2025 and submits that due to the pressure of local politicians the Respondent-JUVNL came with an Employment Notification No. 04/2016, where the cut-off date for calculation of maximum age of applicants shall be 01.01.2016; however, these petitioners have not applied; as such, on the one hand there is no terms and conditions with regard to providing job 2025:JHHC:26396 4 and on the other hand; these petitioners have not made any application under this Employment Notification No. 04/2016; as such, no relief can be granted to these petitioners. 5. Having regards to the admitted facts especially the fact that though the Respondent-JUVNL came with an Employment Notification No. 04/2016, where the cut-off date for calculation of maximum age of applicants shall be 01.01.2016; however, these petitioners have not applied, as such, no relief can be granted to these petitioners. Accordingly, this writ application stands dismissed. (Deepak Roshan, J.) jk
