PUBLIC PROSECUTOR The Court made the following: ...RESPONDENT/COMPLAINANT ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioners/Accused Nos.4 to 7 on bail in Crime No. 165 of 2025 of Vetapalem Police Station, Bapatia District, registered against the Petitioners/Accused Nos.4 to 7 herein for the offences punishable under Sections 318(4), 109(1), 308(5) and 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). %-x -I 2 2. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 3. The allegation against the petitioners/accused Nos. 4 to 7 is that they, with the help of accused No.1, threatened and used criminal force with a knife, caused a bleeding injury to the defacto complainant, and robbed an amount of Rs.4,00,000/- (Rupees four lakhs only) from him. The defacto complainant was admitted to the Government Hospital. Later, the police came, recorded his statement, and registered the FIR. The petitioners were arrested on 24.08.2025, and they have been in Judicial custody for the past 85 days. It is reported that there are five adverse antecedents against petitioner No.1/accused No. 4, namely Crime No. 284 of 2014 of Chirala I Town Police Station; Crime No. 65 of 2025 of Chirala I Town Police Station; Crime No. 258 of 2019 of Chirala II Town Police Station; Crime No. 10 of 2023 of Vetapalem Police Station; and Crime No. 193 of 2024 of Vetapalem Police Station. There seven adverse antecedents against petitioner No.2/accused No.5, namely Crime No.65 of 2015 of Chirala II Town Police Station; Crime No.171 of 2017 of Chirala II Town Police Station; Crime No.264 of 2022 of Vetapalem Police Station; Crime No.8 of 2016 of Vedullapalli Police Station; Crime No.261 of 2023 of Chirala I Town Police Station; Crime No.71 of 2023 of Chirala I Town Police Station; and Crime No.278 of 2021 of Vetapalem Police Station. There are four adverse antecedents against petitioner No.3/accused No.6, namely 4. are ,3 Crime No.82 of 2020 of Chirala I Town Police Station; Crime No.281 of 2021 under the A.P. Prohibition Act of Chirala I Town Police Station; Crime No.71 of 2023 of Chirala I Town Police Station; and Crime No.411 of 2023 of Chirala I Town Police Station. 5. The Petitioner No.4/accused No.7 allegedly gave his auto to the other accused, who used it to commit the alleged offence. Petitioner No.4/accused No.7 is a friend of petitioner No.2/accused No.5. No adverse antecedents reported against petitioner No.4/accused No.7. The allegations levelled against petitioner Nos. 1 to 3/accused Nos. 4 to 6 are severe in nature, and the amount allegedly extorted by them is yet to be recovered. are 6. Considering the gravity and nature of the allegations, as well as the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner Nos.1 to 3/accused Nos.4 to 6 on bail at this stage. The nature and gravity of allegations levelled against the Petitioner No.4/Accused No.7, this Court is inclined to enlarge the Petitioner No.4/Accused No.7 on bail. 7. In the result, the Criminal Petition is partly allowed by dismissing the bail petition against the petitioner Nos.1 to 3/accused Nos.4 to 6, while allowing the bail petition of the petitioner No.4/accused No.7 with the following stringent conditions: i- The Petitioner No.4/ Accused No.7 shall be enlarged bail subject to he executing a bond for a sum of Rs.20,000/- on (Rupees twenty thousand only), with two sureties for the like each to the satisfaction of the learned Additional Junior Civil Judge, Chirala. sum ii. The Petitioner No.4/ Accused No.7 shall appear before the Station House Officer concerned, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The Petitioner No.4/ Accused No.7 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned. The Petitioner No.4/ Accused No.7 shall not commit indulge in commission of any offence in future. The Petitioner No.4/ Accused No.7 shall cooperate with the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. The Petitioner No.4/ Accused No.7 shall not, directly indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer. The Petitioner No.4/ Accused No.7 shall surrender his passport, if any, to the investigating officer. If he claim that he do not have a passport, he shall submit an affidavit to that effect to the Investigating Officer. iv. or V. VI. or vii.
