ORDER
The grievance of the petitioner is that the authorities, without issuing any notice, without acquiring the land and without paying compensation, are attempting to lay a BT surface road in his agricultural land situated in Survey No.188-5C of Samireddipalle village accounts, Samireddipalle Panchayat, Penumuru Mandal, Chittoor District. 2. Sri MatteguntaSudheer, learned Standing Counsel, on written instructions dated 10.12.2025 of the Executive Engineer, PRI Division, Chittoor, submitted that on the objection made by the petitioner, laying of BT road in the subject land was stalled. 3. It is fairly settled that Article 300A of the Constitution, which asserts the Right to Property, means, the authorities cannot seize or interfere with an individual's property without following a proper, lawful procedure, ensuring fairness, notice, and a chance to be heard, rather than acting arbitrarily. 4. The written instructions dated 10.12.2025 placed on record by the learned Standing Counsel nowhere specifies that the procedure established by law was followed before attempting to lay road in the petitioner’s land. 5. In view of the above, this writ petition is disposed of, directing the authorities not to interfere with the petitioner’s possession and enjoyment of

the subject property including laying of road without following due process of law. There shall be no order as to costs. There shall be no order as to costs.
