THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION No.786 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.161 of 2024 of Srikalahasti II Town Police Station, Tirupati District. 2. A case has been registered against the petitioner and others for the offences under Sections 115(2), 109 r/w 3(5) B.N.S. 3. Case of the prosecution, in brief, is that, on 07.11.2024 at about 4.30 pm, the informant went to APSRTC bus station to celebrate his birthday with his friend Bhanu Prakash, and when he reached there, he saw A1 to A4 quarrelling with each other. When he questioned the accused, they slapped the informant and threatened him stating that accused were local and could do anything. Later the informant and his friend left the scene, informed the same to his brother Dinesh at the time of celebrating his birthday by cutting the cake, near the municipal office circle, and after some time A1 to A4 came there and started quarrelling with the defacto complainant and his friend and accused attempted to stab Bhanu Prakash. On that, the said Bhanu Prakash ran away. A2 to A4 chased the deceased and caught hold him. Then A1 stabbed the deceased five times with a knife on the back side of the deceased and 2 escaped. Later the deceased was shifted to Hospital, Srikalahasti. On 11.11.2024 at about 8.20 pm, the investigating officer received the death intimation of the deceased. Basing on the same, he altered the section of law and investigated into and arrested the petitioner/A1 on 09.11.2024. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that investigation is still pending and police are yet to file charge sheet and prays to dismiss the Criminal Petition. 6. A perusal of the material available on record goes to show that heinous acts are attributed against the petitioner that he, with an intention to kill the deceased, stabbed him and while undergoing treatment, the deceased succumbed to the injuries. As stated by the learned Assistant Public Prosecutor, the investigation is at nascent stage and police are yet to file charge sheet. Hence, this Court is not inclined to grant bail to the petitioner/A1, at this stage. 7. Accordingly, the Criminal Petition is dismissed. _______________________ K.
