Ratan, learned Additional Advocate General for the State respondents No.1 and 2 as well as Mr. I. Bam, learned counsel for the respondents No.3, 4 and 5. Page No.# 5/6 2. The learned Additional Advocate General has referred to the order dated 30.05.2024 and it is submitted that the Court had allowed the State respondents to work out the details of excess promotes and/or direct recruits existing in the cadre of Assistant Engineers in the Public Health Engineering& Water Supply Department and that, on conclusion of such exercise, the department was required to prepare a Tentative Agenda Note for placement before the departmental promotion committee, wherein the vacancies were required to be spelled out for grant of retrospective promotion to the respondents No.3, 4 and 5. Accordingly, he submits that said exercise is concluded and an affidavit by the respondent No.2 has been filed on 16.09.2024. Accordingly, it is submitted that there is a consensus amongst the parties i.e., the appellants and the respondents No.3, 4 and 5, by virtue of which, the appellants and the respondents No.3, 4 and 5 have raised no objection, which is appended as Annexure-I to the said affidavit. 3. On the query of the Court, the learned counsel for the appellants as well as the learned counsel for the respondents No.3, 4 and 5 submitted that they have instructions not to oppose the submissions made by the learned Additional Advocate General, subject to the State adhering to the date of retrospective promotion as given in the NOC. 4. Accordingly, as a consensus has been arrived at between the appellants and the respondents No.3, 4 and 5, this writ appeal stands disposed of, granting liberty to the State to constitute a departmental promotion committee to consider the retrospective promotion of the appellants as well as the respondents No.3, 4 and 5, in terms of the consensus arrived at amongst the parties.
