GP FOR REVENUE (AP) 3 HBKM,J W.P.No.7055 of 2020 The Court made the following Order: Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in trying to assign the land in an extent of Ac.1.74 Cents in Sy.No.207 of Vallabharaopalem, Pedapalem, Ponnur Mandal, Guntur District, which was classified as Canal, for house sites under the 'Navaratnalu-Pedalandariki illu'. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter affidavit of the 3rd respondent submits that an extent of Ac.1.74 cents of Government land in Sy.No.207 of Pedapalem Village hamlet of Vallabharaopalem was identified, out of which an extent of Ac.1.56 cents was proposed for house sites and the remaining extent of Ac.0.18 cents was kept for cart track to use the same by the villagers for going to the fields. In the proposed land, about 30 Scheduled Tribe families encroached in an extent of Ac.0.76 cents and constructed thatched houses and they are living in their houses and now the said lands are proposed for providing house sites to the encroachers and eligible beneficiaries in the village. Accordingly, the Grampanchayat also passed the resolution dated 03.01.2020 and this writ petition was filed at the proposed stage only. 4. In view of the above said facts and circumstances, the respondent Nos.2 and 3 are directed to deal with the subject land in an extent of Ac.1.74 4 HBKM,J W.P.No.7055 of 2020 Cents in Sy.No.207 of Vallabharaopalem, Pedapalem, Ponnur Mandal, Guntur District, strictly in accordance with law, if so warranted for any public purpose. 5. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs.
