The appeal has been preferred by the State submitting that while the issue decided in the case of Bharti Upadhayay Vs. State of Rajasthan & Anr. (D.B. Special Appeal Writ No.1122/2017) vide order dated 10.08.2018 but after applying the ratio of the said judgment, the claim of the respondent is not made out. 2. We afraid that the issue was required to be addressed before the learned Single Judge where both the parties conceded of the issues having been decided in the case of Bharti Upadhayay (supra).
