After completion of investigation, police filed charge-sheet in this matter for offences punishable under Sections 115(2), 119(1), 109(1), 126(2), 131, 333, 331(6), 324(5), 324(6), 326(g), 351(2), 111(2) (b) & 3(5) of BNS, 2023.
2. The first bail application filed on behalf of the petitioner was dismissed as withdrawn by this court vide order dated 24.09.2025
[2025:RJ-JP:49271] (2 of 4) [CRLMB-15967/2025] while giving liberty to renew the prayer for bail after submission of result of investigation. Now, charge-sheet has been filed in this matter thus, this second bail application has been preferred.
3.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Counsel submits that none of the injuries sustained to the injured has been opined as dangerous to life. Counsel submits that other co-accused namely Lavish Sayal @ Lavish Boxer and Nagendra Beniwal have already been granted benefit of bail by this Court and learned trial Court respectively. Counsel submits that there are two criminal antecedents of the petitioner wherein he is on bail. It is contended that trial will take considerable time in its conclusion. Counsel submits that petitioner is in custody since 19.08.2025 and further custody of the petitioner would not serve any fruitful purpose.
4. Learned Public Prosecutor opposes the submissions made by
learned counsel for the petitioner.
5. I have considered the contentions.
6. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially considering the material available on record in the form of charge-sheet, as also the fact that co-accused Lavish Sayal @ Lavish Boxer and Nagendra Beniwal have already been granted benefit of bail and trial will take considerable time in its conclusion as well as looking to the period of custody, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow the second bail application.
[2025:RJ-JP:49271] (3 of 4) [CRLMB-15967/2025]
