14.07.2023 of trial court to file neat copy of charge sheet and even subsequent to passing of order of this hon'ble court in CRLP No.5984 of 2022 against Cr.No.2 of 2022 of B. Mattain PS, Kadapa District despite the petitioner reporting to the respondents about vehicle penalties, challances through online to his mobile as illegal, arbitrary, malafie and unconstitutional and violation of Articles, 14, 21 and 300-A of the constitution of India, consequently direct the respondents to forthwith trace, seize and produce the vehicle Vehicle Mahindra Scorpio vide Registration No.AP37CK0089 before the jurisdictional court for handover to the petitioner within timeframe and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct the Respondents to immediately trace, seize and produee the vehicle Seorpio bearing No.AP37 CK 0089 before jurisdictional Magistrate in order to restraining any third party from alienating, transferring or tampering with the said vehicle with a consequent direction to respondent no.2 and 3 to file a detailed status report before this Hon’ble Court within a stipulated time, preferably two weeks, disclosing the steps taken and progress made in the investigation for recovery of the said vehicle and pass Counsel for the Petitioner:

This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue an appropriate Writ Order or direction more particularly one in the nature of Writ of Mandamus to declaring the inaction of respondent no.4 and 5 in not tracing recovering and restoring vehicle of petitioner Scorpio bearing NO.AP37CK 0089 nearly 5 years i.e., from report dt 22.09.2022 and consequent order dt 14.07.2023 of trial court to file neat copy of charge sheet and even subsequent to passing of order of this Hon’ble court in CRLP No.5984 of 2022 against Cr.No.2 of 2022 of B.Mattam PS, Kadapa District despite the petitioner reporting to the respondents about vehicle penalties challans through online to his mobile as illegal, arbitrary, malafie and unconstitutional and violation of Articles 14, 21 and 300-A of the constitution of India, consequently direct the respondents to forthwith trace seize and produce the vehicle Mahindra Scorpio vide Registration No.AP37CK0089 before the jurisdictional court for handover to the petitioner within timeframe…”
2. Heard Sri N.N.Somendra Reddy, learned Counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondents.

Learned counsel for the petitioner would submit that a direction may be given to the police to investigate and file a report.
4. Learned Assistant Government Pleader would submit that Court may pass appropriate orders.
5. Considering the submissions, this writ petition is disposed of. However, the police are directed to look into the grievance of the petitioner since the

vehicle has not been traced out for the last five years and make every effort by conducting proper investigation in this matter and file a report according to law as expeditiously as possible, preferably within a period of three months from the date of receipt of copy of this order. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________________________
