JUSTICE SAMEER JAIN Judgment 28/11/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 244/2025 registered at Police Station Railway Colony District Kota City for the offence(s) under Sections 115(2), 126(2), 3(5) of BNS. 2. Learned counsel for the accused-applicant has submitted that the applicant is sole bread earner for the family, aged 42 years. It is submitted that applicant is in custody ever since 17.10.2025 and there is no criminal antecedent registered against the applicant. It is further submitted that injuries were not assigned to the applicant rather were assigned to his two sons. It is also submitted that there is no recovery of knife from the applicant. Learned counsel further further submitted that the conclusion of trial is likely to take a long time and no useful [2025:RJ-JP:48458] (2 of 2) [CRLMB-14621/2025] purpose would be served by keeping the applicant behind bars till disposal of the case. 3. Per contra, learned Public Prosecutor has vehemently opposed the bail application. Investigating Officer has marked presence in the Court and has submitted that victim was admitted in hospital for more than 10 days and injury sustained to the victim are life threatening in nature. Howsoever, it is not refuted that injuries were assigned to the two sons of the accused- applicant. 4. Having heard the arguments advanced by the learned counsel for the parties and considering the fact that accused- applicant is sole bread earner for the family; that accused- applicant is in custody ever since 17.10.2025; that injuries were not assigned to the accused-applicant; and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Sanjay Son Of Babulal shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
