PUBLIC PROSECUTOR (AP) The Court made the following: 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 7936/2022 ORDER: The instant petition under Section 482 of the Code of Criminal Procedure, 1973 (in short, “Cr.P.C.”) has been filed by the Petitioners/ Accused Nos.1 & 2, seeking quashment of the proceedings pending against him in C.C.No.94 of 2022 on the file of I Additional Judicial First Class Magistrate, Ananthapuram for the offence punishable under Sections 324 & 504r/w34of I.P.C. Heard Sri Atchuthananda Dondeti, learned Counsel for the petitioners 2. and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. Learned Counsel for the petitioners would submit that the petitioners 3. herein are A-1 and A-2. Learned Counsel would further submit that this is a false case lodged against the petitioners. The petitioners have nothing to do \ with the present case and continuing criminal proceedings against them is mere abuse of process of law. Learned Counsel finally prays for allowing the petition. Learned Assistant Public Prosecutor vehemently opposed the petition 4. stating that there are specific allegations against the petitioners as to when the defacto complainant and others visited the house of the accused and asked about the money owed by one Mr. Anil, the petitioners started using abusive language on the defacto complainant and beat the defacto complainant with 3 sticks and rods. Learned Assistant Public Prosecutor would further submit that the wounds suffered by the victims are simple in nature as per the wound certificates and would submit that this is not a fit case for quashment and prays for dismissal of the petition. Considering the submissions made and on a fair look at the material placed on record, as rightly put by the learned Assistant Public Prosecutor, there are specific allegations made against the petitioners to attract the alleged offences. After due investigation. Police filed charge sheet. Learned Trial Judge has taken offences into cognizance. In the light of the specific allegations made against the petitioner, this is not a fit case for quashment by exercising inherent powers under Section 482 of Cr.P.C. In the result, the Criminal Petition is dismissed. 5. 6. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
