Learned State counsel raised a preliminary objection regarding the maintainability of the present anticipatory bail application, as the same is not maintainable in view of the provisions contained in Section 59(A) of the Chhattisgarh Excise Act, to which learned counsel for the applicant could not waive out the preliminary objection raised by learned State counsel. Learned counsel for the applicant could not waive out the preliminary objection raised by the learned State counsel, hence, the present anticipatory bail application of the applicant – Lalit Banjare, apprehending his arrest in connection with Crime No. 304/2025, registered at Police Station – Chakarbhatha, District – Bilaspur (C.G.) for alleged commission of o<ence punishable under Section 34(2) of the Chhattisgarh Excise Act, is dismissed as not maintainable, in view of Section 59(A) of the Chhattisgarh Excise Act.
