Appellant has moved an application (IA No.1/2025) seeking withdrawal of the present execution first appeal stating inter-alia that the objections filed by the appellant, based on an agreement to sale dated 06.08.2018, were dismissed, vide order impugned dated 11.12.2023. However, since thereafter, agreement itself has been cancelled and appellant does not want to pursue his objections. Hence, appeal may be allowed to be withdrawn. 2. Learned counsel for the respondent has no objection to it. 3. Permission is granted. 4. Accordingly, the application is allowed and the present execution first appeal is dismissed as withdrawn. 5.
