ORDER: This Criminal Pet|ltion, under Sect'lons 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short tBNNS') 'IS filed by petitioner/A1, seeking regular bail in Crime No.216 of 2024 of sabavaram police station, vlsakhaPatnam Distr'lct registered for the offences punishable under secti6n 20 (b)(ii)(C) r/w 8(c) of NDPS Act,
1985. 2. Heard Sri B.ParamesWara Rao, learned counsel for Petitioner/Al and sri Neelothpal Ganji, the learned Assistant Public Prosecutor for respondenVState. 3. Perused the record. 4. Having heard the leamed COunSel On both S',deS and Perused the record, it 'ls seen that on 18.09.2024, the raiding Party recovered 30 kgs of ganja and arrested Al to A3, remanded tO judicial Custody. The present petitioner is A1, seeks regular bail. The leamed Assistant Publ-lc prosecutor has opposed the bail applicat'lon. 5. Earlier, this Court granted bail tO A3 and declined tO grant bail tO Al and A2 in Crl.P,No.8524 of 2024, dated 09.12.2024. The submission of the learned counsel for the petitioner -ls that the material part of the invest'lgation has been completed, A3 has already been released On7,
bail, and it is also argued that the investigating agency overlooked the procedure concerning the said facts. I

Considering the fact that the petitioner has been in judicial custody for more than four months and material part of the investigation is over, any further continuation of detention does not seem necessary. Hence, this Court finds that petitioner/Al shall be enlarged on bail. 7. In view of the said circumstances, the Criminal Petition is allowed. Petitioner herein/Al shall be enlarged on bail on executing a personal bond for a sum of Rs.30,000/- (Rupees Thirty Thousand only) with two sureties of the like sum each to the satisfaction of the learned l- Additional District & Sessions Judge, Visakhapatnam. The petitioner is permitted to furnish the sureties from the State of Andhra Pradesh. Petitioner/Al shall mark his attendance before the Investigating Officer I on lst and 15th of every month between 10.00 A.M. and 1.00 P.M. till filing of the charge sheet. Petitioner/Al shall make himself available for investigation by a police officer as and when required, and he shall not, directly or indirectly, make any inducement, threat or promise to any persons acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or to any police officer.
He shall not indulge in similar acts of crime and shall duly attend the trial of the case. The petitioner shall regularly appear before the competent Court and participate in pre-trial and trial process without fail.
