The grievance of the petitioner is that the execution petition filed by her seeking execution of order dated 26.09.2012 passed by learned Special Mobile Magistrate, Electricity, Jammu, granting maintenance in her favour in proceedings under Section 488 of Cr.P.C, which order has been upheld by the Superior Fora, is not being effectively proceeded with by the Executing Court i.e. the learned Additional Principal Judge, Family Court, Jammu. 02. It has been submitted that the petitioner has moved the execution petition on 24.02.2023 before the learned Executing Court but no effective steps are being taken by the said court as a result of which, the petitioner is not Serial No. 104 2 CM(M) No. 263/2025 able to reap the fruits of order of maintenance passed in her favour. 03. Having regard to the nature of relief that has been sought by the petitioner in this petition, the same can be disposed of at this stage, by extending appropriate directions to the learned Executing Court. 04. Accordingly, this petition is disposed of with a direction to the learned Executing Court i.e. the learned Additional Principal Judge, Family Court, Jammu to take all necessary steps as are available under law to execute the order of maintenance passed in favour of the petitioner. 05. Disposed of, accordingly. 06. Copy of this order be sent to learned Additional Principal Judge, Family Court, Jammu.
