1. This is an o7ce reference.
2. This Court, vide order dated 01.09.2023 passed in MCRC No. 6071 of 2023, while allowing the bail to the applicant, namely, Bholu @ Shambhu Nayak had expressed its trust that the trial Court would make an earnest endeavor to conclude the trial expeditiously in accordance with law, preferably within a period of six months from the date of receipt of a certiBed copy of the order, if there was no legal impediment.
3. The learned Chief Judicial Magistrate, Bastar place Jagdalpur District-Bastar Place Jagdalpur (C.G.) vide his request letter dated KUNAL DEWANGAN Digitally signed by KUNAL DEWANGAN
2 08.10.2025 has requested for grant of some more time for concluding the trial.
4. It transpires from perusal of the PUD that at present, the case is Bxed for prosecution evidence, in which the statements of nine witnesses are yet to be recorded. Most of the witnesses in this case are o7cial witnesses belonging to the Police and Excise Departments. Due to their engagement in law and order duties and the non-execution of issued summons/warrants, the case could not be disposed of within the stipulated period. The delay has occurred due to exceptional and unavoidable circumstances beyond control. Therefore, it is most respectfully prayed before this Court that a further period may kindly be granted for the proper disposal of the case.
5. The request appears to be reasonable. The concerned trial Court is
directed to conclude the trial as early as possible, preferably within a further period of four months from today.
6. Accordingly, this CRMP stands disposed o7 with the aforesaid direction.
