Respondent/Complainant Petition under Sections 482 of BNSS (old 438 of Cr.P.C), praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to direct the Station RSASTF Police Station, Tirupati District to release House Officer, the petitioner/Accused No.16 on bail in the event of his arrest in connection with C^e No. 145/2023 of RSASTF Police Station, Tirupati District. The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri D PURNACHANDRA REDDY, Advocate for PROSECUTOR for the Respondent and the Court made the following; the Petitioner and of PUBLIC r THE HONOURABLE SRI JUSTICE T MALLIKARJUNA RAO CRIMINAL PETITION NO: 4264 of 2025 ORDER:- The Criminal Petition, under Section 482 of the BNSS, is filed on behalf of the petitioner herein/A16 to grant anticipatory bail in connection with Crime No. 145 of 2023 of RSASTF Police Station, Tirupati. 2. The above said crime was registered against the petitioner and others for the offences punishable under Sections 379 read with 34 IPC and Sections 20(1)(d)(i)(a) read with 20(1 )(c) ii, iii, iv, x, 36(a) read with 32A, 29(4)(a)(i) of A.P. Forest (Amendment) Act, 2016. 3. Case of the prosecution, in brief, is that this is a case of criminal trespassed into reserve forest without permission, cut the live red sander trees and committed theft and trying to shift by loading for the purpose of smuggling red sander logs that occurred on 18.10.2023 at about 5.00 AM, near Bharath Petrol Bunk, Badvel-Khajipeta NH Road, Lothuvanka Forest Beat Vatimadugu Section, wherein A1 to A4 were arrested and seized 16 red sander logs, Mahindra Tractor bearing Reg.No.AP39 TB 6472 with Tanker, TATA Indica Car bearing w 2 Reg.No. AP24 Q 7848, Honda Shine motor cycle bearing Reg.No.AP39 AU 1046 from their possession. Heard. Perused the record. Learned counsel for the petitioner submits that the petitioner/A16 is the wife of A5, and the vehicle is registered in her name. It is alleged that the red sander was being transported in the vehicle owned by A16. Learned counsel for the petitioner further submits that the petitioner is a housewife and has no involvement in the activities of her husband. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner herein. He further submits that the petitioner has no previous criminal 4. 5. 6. antecedents. It is submitted that the petitioner herein had permanent abode and there is no possibility of her fleeing away from the justice and most of the witnesses are official witnesses and release of the petitioner would not cause hampering of investigation and hence, this Court is inclined to grant anticipatory bail to the petitioner herein, on the following 7. conditions; (i) The petitioner/A16 is directed to surrender before the Station House Officer concerned, within a period of two (2) J 3 weeks from the date of receipt of a copy of this order. On such surrender, the petitioner/A16 is ordered to be enlarged on bail on her executing a personal bond for Rs. 10,000/- (Rupees ten thousand only) with two sureties for the like sum each to the satisfaction of the Station House Officer concerned. (ii) The petitioner shall make herself available for investigation as and when required and that she shall not cause any threat, inducement or promise to the prosecution witnesses. 8.
