CM-8855-CII-2025 This is an applicaon under Secon 5 of the Limitaon Act to condone the delay of 49 days in filing the appeal. Heard. For the reasons as menoned in the applicaon, supported by an affidavit of the appellant, the delay of 49 days in filing the appeal is hereby condoned. The applicaon stands disposed of. FAO-2775-2025 This appeal is filed by the claimants seeking enhancement of compensaon.
2. It is contended by learned counsel for the appellants that the income of the deceased to be `9,803/- per month as taken by the Tribunal is on the lower side as the deceased was working as a Fi2er at Shri Mahadeva Kotex, Kabri Road, Panipat and was earning `20,000/- per month.
3. On a specific query to learned counsel for the appellants, it is conceded that deceased was doing private work. He was not an income tax assessee. There was no documentary proof to show that deceased was Sarita Rani 2025.08.25 17:50 I attest to the accuracy of this document/order

The Tribunal has taken into consideraon the amount of `9,803/- as the income of the deceased on noonal basis based on minimum wages for an unskilled worker. This Court does not find any illegality or perversity in the finding recorded by the Tribunal. As such finding no merit in the present appeal, the same is dismissed. August 25, 2025
