The petitioner has been made accused in connection with Special POCSO Case No.01 of 2025, arising out of Tonto P.S. Case No. 36 of 2024 in M.C.A. No.84 of 2025, for the offence under Section 70(2) of BNS and Sections 4/6 of POCSO Act, pending in the court of learned Additional Sessions Judge-II-cum-Special Judge (POCSO) at Chaibasa, Jharkhand. On 23.10.2024, petitioner alongwith co-accused persons are alleged to have gang raped the prosecutrix. It was submitted that the statements of the victim and her mother have been recorded during trial and there are vital contradictions in their statements. Learned A.P.P on behalf of the State has opposed the prayer for bail and submitted that victim has supported her case during trial. In view of the nature of allegation, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is rejected.
