Learned counsel submits that the petitioner has not been appointed despite the fact that he was eligible in all respects for appointment as English Mistress.

Learned State counsel refers para 1 of the counter affidavit dated 11.08.2009 filed by Director, Public Instructions (SE), Punjab, to which no counter was filed and could not be disputed even during the course of arguments inasmuch as the petitioner in her graduation did not have English as an elective subject, which reads thus:
“ 1. That the petitioner through the present writ petition has prayed for quashing the clarification dated 27-2-2008 Annexure P-7 published in Daily Ajit on the ground that the respondents have declared the candidates with Master's degree in English ineligible for the appointment as masters/mistresses In this regard it is respectfully submitted that vide the said clarification, Annexure P-7, it has not been declared that the candidates who have master's degree in English are not eligible for the posts of Educational Services Providers in the subject of English. Vide the said clarification it has only been clarified that the candidates who possess the qualification of Masters in MOHIT 2025.05.23 10:55 I attest to the accuracy and integrity of this document
CWP-18676-2008 (O&M) -2- English are exempted from passing the subject of teaching of English during their examination of B.Ed.Meaning thereby a candidate who has passed M.A. in English with B.Ed. (Even without the subject of teaching of English during the B.Ed.) however, has passed the examination of B.A. with English as an elective subject is eligible for the post of Educational Services Providers in the subject of English However, as the petitioner has not passed her graduation examination with English as an elective subject, thus the petitioner is not eligible for the said post in terms of the qualification as prescribed vide Part-I of the qualifications for the posts of English masters/ mistresses in the advertisement dated 30-8-2007 Annexure P-4 and subsequent corrigenda issued in relation to the said advertisement.”
