JUSTICE VINOD KUMAR BHARWANI Judgment 19/11/2025 The instant bail applications have been filed under Section 483 B.N.S.S. on behalf of accused-petitioners in the matter arising out of F.I.R. No. 473/2025 registered at Police Station Hindaun Sadar District Karauli for the offence(s) punishable under Section(s) 8/21 NDPS Act. [2025:RJ-JP:46667] (2 of 3) [CRLMB-14963/2025] Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case, they have nothing to do with the alleged offence and they are behind the bars since 28.10.2025 & 29.10.2025, respectively. Learned counsel further submits that the alleged contraband smack (9.18 milligrams) is below commercial quantity and has been recovered from Rajendra Kumar. Trial of the case is likely to take a long time to conclude, till then, their further incarceration would not serve any fruitful purpose and they are ready and willing to furnish their bail bonds. Therefore, the bail applications deserve to be allowed. Learned Public Prosecutor has vehemently opposed the bail applications. Heard learned counsel for the parties and perused the material available on record. Taking into consideration the submissions put forth and overall facts and circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail. Therefore, the bail applications are allowed. Accused- petitioners namely- (i) Rajendra Kumar S/o Shri Udairaj & (ii) Munesh Meena S/o Shri Babulal shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any other court to which the matter is transferred, on all [2025:RJ-JP:46667] (3 of 3) [CRLMB-14963/2025] subsequent dates of hearing and as and when they are called upon to do so.
