GP FOR IRRIGATION COMM AREA DEV 2 The Court made the following: ORDER: This writ petition is filed under Article 226 of Constitution of India with the following prayer for : <…declaring the action of the Respondents in not paying compensation amount fully to us i.e. the petitioners for the land acquired i.e. totally admeasuring Ac.31.52 cents in Sy.No. 301/2 and Sy No. 301/3, situated at Bhimavaram Village of Samarlakota Mandal in Kakinada District, as bad, arbitrary, contrary to the provisions of Land Acquisition Act, 1894 contrary to the parameters specified in Act 30 of 2013 and also offends Arts. 14, 21 and 300-A of Constitution of India and direct the respondents to pay the balance compensation amount to the petitioners as per the provisions of Act 30 of 2013 basing on prevailing market value.= 2. The petitioner was entrusted with the execution of work for <Regradation of Talarivani Vanka near Goridindla Village in Atmakur Mandal of Anantapuram District= vide Agreement.No.234/2018-19 dated 17.11.2019, for an estimation of Rs.4,11,060/-. Further, the petitioner also entrusted with the execution of work for <Regradation of Mangaloni Madikattu Vanka to feed Vepacherla tank near Goridindla Village in Atmakur Mandal of Anantapuram District= vide Agreement.No.229/2018-19 dated 17.01.2019, for an amount of Rs.4,35,120/-. 3 3. The petitioner completed the above works within the stipulated time and after checking the works done by the petitioner, the same was recorded in the M-Book by the respondent authorities, but the respondent authorities failed to pay the bills till date. Challenging the same the present writ petition came to be filed. 5. Today, when the matter came up for hearing, the learned Government Pleader, placed on record a copy of the instructions issued by the Executive Engineer, I.B Division, Ananthapuram vide Letter.No.AB/S.2/Neeru Chettu court cases/No.685M dated:12.11.2025 wherein it is stated that the payments in respect of the execution of the works done by the petitioner were paid on 20.09.2025, the details of which are furnishing here : S.NO Name of the work Details of the payment Date 1.
