[2025:RJ-JP:4380] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1315/2025 1. Jahid S/o Kasim Khan, Aged About 28 Years, R/o Rojki, Police Station Nagar, District Deeg, Presently R/o Belaka, Police Station Vaishali Nagar, Alwar (Raj.) 2. Akram S/o Ali Mohammad, Aged About 31 Years, R/o Village Belaka, Police Station Vaishali Nagar, Alwar (Raj.) (At Present Accused- Petitioner Confined In Central Jail Alwar) ----Petitioners Versus State Of Rajasthan, Through P.P. ----Respondent For Petitioner(s) : Mr. Gurvindra Singh For Respondent(s) : Mr. Devi Singh Chaudhary, P.P. HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 31/01/2025 The instant bail application has been filed under Section 439 Cr.P.C./483 B.N.S.S. on behalf of accused-petitioners in the matter arising out of F.I.R. No.974/2022 registered at Police Station N.E.B., District Alwar for the offence(s) punishable under Section(s) 147, 148, 149, 332, 333, 336, 353, 458 & 307 of I.P.C. and under Section 3 of PDPP Act. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case, they have nothing to do with the alleged offence and they are behind the bars since 06.01.2025. Counsel further submits that the other co- accused persons have already been granted bail by this Court and [2025:RJ-JP:4380] (2 of 2) [CRLMB-1315/2025] the petitioners are not named in the F.I.R. Trial of the case is likely to take a long time to conclude. Till then their further incarceration would not serve any fruitful purpose and they are ready and willing to furnish their bail bonds. Therefore, the instant bail application deserves to be allowed. Learned Public Prosecutor has vehemently opposed the bail application. Heard learned counsel for the parties and perused the material made available on record. Taking into consideration the submissions put forth and overall facts & circumstances of the case but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused-petitioners on bail. Therefore, the bail application is allowed. The accused- petitioners, namely Jahid S/o Kasim Khan & Akram S/o Ali Mohammad, shall be released on bail, if they are not required in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/- (Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any other court to which the matter is transferred, on all subsequent dates of hearing and as and when they are called upon to do so.
