ORDER:- This Criminal petition, under sectl®ons 480 and 483 of the Bharatl'ya Nagarik Suraksha SanhI-ta, 2023, has been filed by the petitI-Oner/A8, seeking regular bail, in crime No.236 of 2024 of Prakash Nagar Poll-Ce Station, Rajahmahendravaram. 2. A case has been registered against the petitioner herein and others for the offences punishable under Sections 126(2), 324(4), 262, 253,132,
\ 121(1), 109(1), 309(4-) ,and 351(2) read wlth 49 of the Bharatlya Nyaya Sanhl-ta, 2023. 3. case of the prosecutl'on, jn brief, js that, as perthe jnstructl'ons of the Inspector of poIICe, JR Puram, srjkakulam Dlstrlct, the sub-Inspector of poII'Ce, Laveru pollce statI'On, Srlkakulam Dlstrl'ct, along wlth hl's staff, went to BhI'mavaram, West Godavarf' and caught hold of Rapaka prabhakar @ pratap Reddy, who is arrayed as accused jn crime No.119 of 2024 of G.Sjgadam poll-ce statl|on and a" went to prakashnagar po'jce stall-on to enquire about the other accused I'n the saI-d crl|me. While they were returning to srjkaku'am on the same day at about ll.30 PM near croma shoppI'ng Mall, RTC Complex Road, Rajamahendravaram, some unknown persons obstructed and assaulted them with cricket bats and sticks and also with hands and damaged the vehicles and snatched the case documents and robbed cash of Rs.10,000/-from the sl of police and forcl®bly took away the vehicle keys and escaped from the place along with Rapaka prabhakar @ pratap Reddy. 4. Heard. perusedtherecord. 5. A perusal of the material on record goes to showthat basl-ng on the confessional statement of co-accused, the petjtjoner hereI-n Was Shown as accused jn the present crime. Except the confessional statement of co- accused, there js no other material to connect the petltjOner herel-n to the
f/ alleged crime. The petI'tiOner herein Was arrested On 17.12.2024 and since then he is languishing in jail. lt is submitted by the learned counsel for the petitioner that other accused in the present crime were already granted bail by this Court. The case of the petitioner herein also stands on the same footing to that of the A14 & A17. Learned Assistant Publl'c Prosecutor submitted that major portion of investigation has been completed. 6. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner/A8 on the following conditions.
i) The petitioner/A8 shall be released on bail on his executing personal bond for Rs.10,000/- (Rupees Ten Thousand only) with two sureties of the like sum each to the satisfaction of the learned ll Additional Judicial Magistrate of First Class, RajamahendraVaram. ii) on release, the petitioner shall appear before the Station House officer concerned, once ih a week i.e., on every Saturday between 10.00 am and o1.00 pm, till filing of the charge Sheet. 7.
