Respondents ----------------------------------------------------------------------------------------------- For Petitioners : Mr. Sourabh Sonwani, Advocate For Respondent No.1/State : Mr. Malay Jain, Panel Lawyer ----------------------------------------------------------------------------------------------- Hon'ble Mr. Ramesh Sinha, Chief Justice Hon'ble Mr. Bibhu Datta Guru , Judge Order on Board Per Ramesh Sinha, Chief Justice 26.11.2025 1 Heard Mr. Sourabh Sonwani, learned counsel for the petitioners as well as Mr. Malay Jain, learned Panel Lawyer, appearing for the State/respondent No.1. 2 The present petition has been filed by the petitioner under Section ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :- “It is, therefore, prayed that this Hon'ble Court may kindly be pleased to exercise its inherent jurisdiction under Section 528 of B.N.S.S., 2023 and in exercise thereof call for the records, if necessary, admit the petition and may kindly be pleased to allow this petition and to quashing of the FIR no. 300/2023 as well as 300 charge sheet filed before the learned trial court which is registered as criminal no. case 10093/2023 on 22.12.2023 and cognizance order dated 22.12.2023, for offence punishable under Section 294, 323, 506, 34 of the IPC by the Police Station Pachpedi, District Bilaspur (C.G.), Cognizance Order (First Order Sheet) dated 22.12.2023 in Criminal Case No. 10093/2023 which is pending before the Judicial Magistrate First Class, Bilaspur, Bilaspur District Bilaspur (C.G.) and (if any), all consequent proceedings incidental & accidental thereto and orders prejudicial to the petitioners herein and/or pass such other orders in favour of the petitioners as this circumstances of the case.” 3 From perusal of the prayers and pleadings made in the instant petition, it transpires that the present petition has been filed by the petitioners seeking quashment of FIR which was registered way back in the year 2023 and for quashment of criminal proceedings pending against them in Criminal Case No. 10093/2025 before the Judicial Magistrate First Class, Bilaspur, but on a pointed query being asked from learned counsel for the petitioner about 3 status of trial, he could not able to give plausible explanation as he had filed the order-sheet of the learned trial Court upto 18.07.2024 only, as such, this Court is of the opinion that the petition drafted by learned counsel for the petitioner is in a very casual manner. 4 Accordingly, the instant petition is dismissed on this ground alone with liberty to file a duly constituted petition along with latest order-sheets of the trial Court. 5 Certified copy of the charge-sheet (Annexure-P/1) shall be returned back to learned counsel for the petitioners after retaining photocopy of the same.
