The instant writ application has been preferred by the petitioner for the following relief:
“That, in the instant writ application the Petitioner prays for issuance of a writ in the nature of Mandamus or any appropriate writ/ order commanding upon the respondents to pay the difference of amount on account of his posting as Executive Engineer (Current Charge) on his own pay scale for the post of Assistant Engineer for the period from
“06.01.2004 to 29.07.2008" with Annual Increment and Interest @10% per annum from the date of due till the date of actual payment and within a specified period.”

Learned counsel for the petitioner submits that in November 1995, the petitioner was promoted on the post of Assistant Engineer. Subsequently, the Petitioner took the charge of the Executive Engineer on 06.01.2004 and he continued on the said post till 29.07.2008 on the pay scale of Assistant Engineer. Learned counsel submits that in view of the
judgment of this Court, the Petitioner is entitled to differential amount by way of difference in the pay scale for the post of Executive Engineer and Assistant Engineer.
As such, he submits that the 2nd Respondent may be directed to take a decision with regard to the grievance of the Petition by passing an order.

Learned counsel for the respondents submits that the Petitioner has

been given regular promotion to the post of Executive Engineer by Departmental Notification No. 3277 dated 19.06.2013.

Having regard to the aforesaid facts and circumstances of the case and looking to the prayer made in the instant writ application, the same is hereby disposed of by directing the 2nd Respondent to treat this writ application as representation and take a decision in the matter with regard to the claim raised in the writ application including the consequential benefits in accordance with law and applicable rules and regulations by passing a reasoned and speaking order.
The entire exercise shall be completed within a period of 12 weeks from the date of receipt/production of copy of this order. The petitioner is also directed to serve the copy of this writ application to the 2th Respondent at the earliest so that his grievance can be redressed.
