1. This Writ Petition under Article 226 of the Constitution of India has been filed for the following reliefs:- 10.1 That, the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondents to immediately disburse terminal dues which includes payment of gratuity, pension, provident fund, group insurance, leave encashment and other retrial dues along with interest, in the interest of justice. 10.2 That, the Hon'ble Court may kindly be pleased to issue a writ of mandamus directing the respondents to immediately inform the petitioner regarding all the service related benefits / reliefs provided to the family of deceased employees of respondents, which the petitioner is entitled to receive after the death of her husband. 10.3 Any other relief which this Hon'ble Court may deem and proper in the present circumstances of the case. 2. At the outset, learned counsel for the petitioner submits that the present petition may be disposed of reserving liberty in favour of the petitioner to prefer a fresh representation raising all her grievances before the Respondent No.2-Commissioner, Department of Tribal and Scheduled Caste who in turn shall decide the said representation within a stipulated time frame. 3. Counsel for the other side would not oppose the aforesaid prayer. 4.
Considering the limited prayer made by the petitioner, this Court deems
3 it appropriate to direct that if the petitioner or any children of the deceased employee prefers a fresh representation within a period of 30 days of this order before Respondent No.2-Commissioner, Department of Tribal and Scheduled Caste, Respondent No.2, in turn, shall consider and decide the same by a speaking order within 120 days from the date of filing of said representation, in accordance with law. 5. With the aforesaid direction, this Writ Petition stands disposed of. Sd/-
