1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicants who have been arrested in connection with Crime No.119/2025 registered at Police Station Baikunthpur, Distt.- Koriya (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) & 111 of BNS.

Case of the prosecution, in brief, that the applicants are account holder of respectively account No. 60488270156 and 60488270316 of Bank of Maharashtra Branch Baikunthpur, in the account of applicant VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2025.11.24 11:04:41 +0530
2 No.1 Rs.6,04,247/- was credit and Rs.6,04246.97/- was debited, and Rs.4,95,380.78/- was credited and Rs.4,95,379.30/- was debited from the account of applicant No.2. That the online crime the bank accounts of the applicants were used. The applicants gave their bank accounts to the member of organized group. The FIR has been registered against the applicants. Hence, this bail application.

Learned counsel for the applicants submit that the applicants are innocent and have falsely been implicated in this case and the applicants have no role in the alleged offence. He would submit that the applicants have no connection with any organized or cyber-criminal activity. He would submit that bail applications of the co-accused persons namely Rajkumar, Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively. He would submit that charge sheet has been filed, the applicants are in jail since 24/04/2025 and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicants. 4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case before the competent court. He would further submit that applicants have no criminal antecedents. He also submits that in compliance of the Court’s order dated 09/10/2025, the Investigating Officer has filed his personal affidavit. He further submits that co- accused persons namely Rajkumar, Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, nature and gravity of allegation levelled against the applicant and the fact that the bail application of the co-accused persons namely Rajkumar, Paremeshwar Kurre and Akshay Kumar Sonwani were rejected by this Court vide order dated 03.09.2025 and 11.07.2025 in MCRC No.7032 of 2025, MCRC Nos. 4138 of 2025 and 4154 of 2025 respectively, further considering the fact that the applicant along with co-accused persons knowing provided their bank account to cyber fraudsters for carrying out illegal financial transactions hence, this Court does not find it to be a fit case to release the applicants on regular bail. 7. Accordingly, the bail application of applicants Sonu Kumar and Samaylal involved in Crime No.119/2025 registered at Police Station Baikunthpur, Distt.- Koriya (C.G.) for the offence punishable under Sections 317(2), 317(4), 317(5) & 111 of BNS, is rejected. 8.
