GOPALA KRISHNA RAO TRANSFERCIVIL MISCELLANEOUSPETITIONNo.69 of 2025 ORDER: Today, when the matter was taken up for hearing, learned counsel for the petitioner submitted that the notice sent to the respondent was personally served on 04.04.2025. He further submitted that the proof of service memo was filed before the Registry under U.S.R. No.49784 of 2025, along with the postal track consignment sheet downloaded from the Postal Department web-site and the same has been placed on record. As per the said postal track consignment sheet, the Registered Notice sent to the respondent by the learned counsel for the petitioner was served. But none appeared for the respondent. Therefore, ‘service held sufficient’. The petitioner/wife herein filed the present petition under Section 24 of 2. the Code of Civil Procedure, 1908, (for short ‘the C.P.C.’) seeking to withdraw the O.S.No.118 of 2024 on the file of the Principal Junior Civil Judge Sullurupeta, Nellore District and transfer the same to the I Additional Junior Civil Judge, Tenali, Guntur District, for trial. The case of the petitioner in brief is as follows: 3. I. The petitioner is the legally wedded wife of the respondent and the marriage of the petitioner with the respondent was solemnized on NO VGKR, J Tr.C.M.P.No.69 of 2025 Dated 05.05.2025 2 02.05.2010, at Tenali, as per the Customs of Muslim Law. During their wedlock period, the petitioner and the respondent were blessed with two (2) children. After that, due to the matrimonial disputes between both the spouses, the petitioner/wife has been residing separately along with her two (2) children aged about 13 years & 11 years respectively,, at her parents’ house at Tenali Town, Guntur District. In view of the harassment made by the respondent/husband, the petitioner/wife lodged a complaint against the respondent/husband and his family members, dated 09.02.2023, in F.I.R.No.25 of 2023, under Section 498-A of I.P.C. and under Sections 3 & 4 of the Dowry Prohibition Act, 1961, before the I Town Police Station, Tenali. After completion of investigation. Police filed a charge sheet and it was numbered as vide C.C.No.161 of 2023 on the file of the I Additional Junior Civil Judge, Tenali, Guntur District and she also filed a Maintenance Case vide M.C.No.21 of 2023 on the file of the I Additional Junior Civil Judge, Tenali, Guntur District, under Section 125 of Cr.P.C., seeking monthly maintenance from the respondent/husband and the said two (2) cases are pending for adjudication against the respondent/husband herein. The petitioner/wife further pleaded that to cause unnecessary inconvenience to her, the respondent/husband had filed O.S.No.118 of 2024 on the file of the Principal Junior Civil Judge, Sullurupeta, Neljore VGKRJ Tr.C.M.P.No.69 of 2025 Dated 05.05.2025 3 District, under Section 26 Order 7 Rule 1 of Civil Procedure Code, 1908, (for ‘short the C.P.C’.) seeking dissolution of the marriage and the same is also pending for adjudication. The petitioner/wife further pleaded that, she being a woman, residing separately along with her two (2) children aged about 13 years & 11 years respectively at her parent’ house at Tenali Town, Guntur District, it is very difficult for her to travel at a distance of more than 250 Kms from Tenali Town to Sullurupeta to attend the divorce case proceedings on each and every adjournment without any male support and that she is constrained to file the present petition seeking to withdraw the O.S.No.118 of 2024 on the file of the Principal Junior Civil Judge, Sullurupeta, Nellore District and transfer the same to the I Additional Junior Civil Judge, Tenali, Guntur III. District. Heard learned counsel for the petitioner. 4. 5. Though the notice sent to the respondent through Registered Post and was served on him on 04.04.2025, none appeared for the respondent. Therefore, ‘service held sufficient’. Perused the material available on record. 6. No. 69 of 2025 Dated 05.05.2025 4 residing separately at her parents’ house along with her two (2) children at Tenali Town, Guntur District and she also filed (2) two cases against the respondent/husband herein i.e., C.C.No.161 of 2023 and M.C.No.21 of 2023 the file of the I Additional Junior Civil Judge, Tenali, Guntur District, the on same are pending for adjudication before the competent Court at Tenali. The material on record further reveals that the respondent/husband has also instituted a case i.e., O.S.No.118 of 2024 on the file of the Principal Junior Civil Judge, Sullurupeta, Nellore District, under Section 26 Order 7 Rule 1 of Civil Procedure Code, 1908, (for ‘short the C.P.C.) seeking dissolution of the marriage and the same is also pending for adjudication.
