This petition is filed by defendants No.1, 7 to 9 challenging the order dated 30.01.2024 in O.S.No.170/2022 on the file of Senior Civil Judge and JMFC, Ron dismissing I.A.No.4 filed by defendants No.1, 7 to 9 under Order 7 Rule 11(a) and (d) of CPC. - 3 - NC: 2025:KHC-D:5661 CRP No. 100087 of 2024 3. It is submitted by the petitioner/party-in-person - Sri.Venkanagouda that, there is no cause of action to file the suit by the plaintiff and also the order in R.A.No.76/2013 has reached finality and therefore contended that, the impugned order passed by the Trial Court requires to be interfered with in this petition. 4. Having taking note of the submission made by the petitioner/party-in-person - Sri.Venkanagouda, I have carefully examined the averments made in the plaint. Undisputedly, the prayer made in the plaint is with regard to seeking declaration that the plaintiff is entitled for 1/4th share in the suit schedule properties in terms of the registered Will dated 10.05.2011 and consequential reliefs. 5. In that view of the matter, taking into consideration the averments made at paragraph Nos.11 to 13 of the plaint, I am of the view that the Trial Court after considering the material on record, rightly dismissed the I.A.No.4 filed by defendants No.1, 7 to 9 seeking rejection of the plaint. - 4 - NC: 2025:KHC-D:5661 CRP No. 100087 of 2024 6. It is also to be noted that, securing of the probate is optional insofar as Hindus are concerned. In that view of the matter, the arguments advanced by the petitioner/party-in-person - Sri.Venkanagouda cannot be accepted. 7.
