The petitioner is arrayed as A4 in Crime No.156 of 2025 registered for the offences under Sections 297(1), 318(4), 61(2) BNS and Sections 5 and 7(1) of Lottery Regulation Act alleging that the petitioner and others were engaged in online lottery tickets selling which was prohibited by the Tamil Nadu Government and earned substantial amount of money and purchased jewels and mobile phones out of that money. After registration of the FIR, the respondent made raid on the petitioner's residence and seized 1) Gold Aaram -4 sovereign 2) Gold Hand Bangle (1 set) - 2 sovereign 3) Vivo Y16 Mobile - IMEI 1: 869554062599895, IMEI 2: 869554062599887, 4) Vivo V19 Mobile - IMEI 1: 869473047784516, IMEI 2: 869473047784508, 5) Cash-Rs.30,000/- (Denomination-500x60=30,000/- and produced before the trial Court. Therefore, the petitioner filed a petition for return of the property and the same was dismissed. Aggrieved by the same, the present revision is filed. 3. The learned counsel for the petitioner submitted that based on the confession of the first accused, the petitioner has been implicated as an accused. In fact, there was no recovery of any lottery tickets. The jewels were purchased by his father-in-law's family and the same was 2/5 https://www.mhc.tn.gov.in/judis Crl.R.C No.545 of 2025 gifted during their marriage. That apart, the petitioner is a handicapped person and he did not commit any offence as alleged by the prosecution. The jewels, mobile phones and cash which were recovered from the petitioner are no way connected with the crime proceeds. 4. The learned Government Advocate (Crl. Side) would submit that along with the jewels, cash and mobile phones, 6 nos. of lottery tickets were recovered from the petitioner under the seizure mahazar and the same were produced before the trial Court. The petitioner was involved in similar offences on three occasions. Therefore, the trial Court rightly dismissed the petition for return of property. 5. On perusal of the records revealed that along with jewels, cash and mobile phones, 6 nos. of lottery tickets were recovered from the petitioner. All the recovered materials were produced before trial Court. Though the petitioner is a handicapped person, he is involved in similar offences and 3 other cases are pending against him. Though the petitioner has been implicated as an accused on the confession statement of the first accused, the properties were recovered from the petitioner only and as such, this Court find no fault with the order passed by the trial 3/5 https://www.mhc.tn.gov.in/judis Crl.R.C No.545 of 2025 Court. 6.
