Endowments Tribunal at Pedakakani as well as Xeroc Copy ofthe Decree also and pass IA NO: 2 OF 2017(CMAMP 1710 OF 2017 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to condone the delay of 127 days in filing the above CMA against OA NO. 991/2010 (Old NO. 76/2007) on the file of A.P. Endowments Tribunal at Pedakakani and pass IA NO: 3 OF 2017(CMAMP 1711 OF 2017 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to suspend the operation of the Decree and Order dt.

JUDGMENT:
Since learned counsel appearing for appellant passed away, this Court, by order dated 22.07.2025, directed the Registry to issue notice to the appellant.
2. As per the office report furnished, notice on sole appellant returned unserved with endorsement “Insufficient address”. As notice has been issued on the correct address as shown in the cause title of memorandum of appeal, service is deemed to be sufficient.
3. As there is no representation for appellant despite service of notice, it is evident that the appellant is not interested in pursuing the appeal. In view of the same, I.A.No.2 of 2017, which is filed seeking to condone the delay of 127 days in filing the appeal and the Civil Miscellaneous Appeal are dismissed for non-prosecution. There shall be no order as to costs.
