1. The applicant has preferred this First Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 685/2022, registered at Police Station Masturi, District- Bilaspur (CG) for the offence punishable under Section 302 of IPC. 2
2. The prosecution story in brief, is that, the brother of deceased lodged FIR that he is a resident of Village Madhuwa to do daily wager and farming work. His sister Chandrika Bai married to the present applicant at Village Limtara about one and half years ago both of them do not have children. The present applicant doubted the deceased’s character and used to scold her and bitted her after arguing for the same. On 22.12.2022, the brother of deceased came to know through phone in morning that the present applicant on 21.12.2022 has doubted the deceased’s character and assaulted her in his house due to which the deceased registered complaint against the applicant. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. There is no eye witness in this case and only on the basis of memorandum of statement the applicant has falsely involved in the crime. The charge sheet has already been filed. The applicant is in jail since 22.12.2022 and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. Out of 16 witnesses, 9 have already been examined and the deceased received multiple injuries. 5. I have heard learned counsel for the parties and perused the case diary. 3

Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, the applicant assaulted his wife (deceased) on her head, chest, stomach, both hands and legs and on her face with stick, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Shankar Suryawanshi involved in Crime No. 685/2022 under Section 302 of IPC at Police Station-Masturi, District- Bilaspur, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
