GP FOR HOME 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 28514 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: <…to issue a writ, order or direction more particularly one in the nature of writ of Mandamus to direct the respondents in terms of Sec.6 (2) (f) of the Indian Passports Act to permit the petitioner to leave the India enabling the petitioner to reach Kuwait and continue his employment without reference of pendency of the criminal case in the FIR No.26/2025 on the file of II Town police station, Anantapur, Anantapur District in the interest of justice.…= 2. Heard Sri P.Nagendra Reddy, learned counsel for the petitioner and Sri V.Farooq, learned Assistant Government Pleader for Home for the respondnets. 3. Learned counsel for the petitioner would submit that the petitioner has been working in Kuwait since 1982. When he visited India, a case has been lodged against him in FIR No.26 of 2025 for the offences punishable under Sections 318(4), 351(2) r/w 3(5) of BNS on the file of II Town Police Station, Anantapur, Anantapur District. Learned counsel for the petitioner would submit that the petitioner was released on bail and they can approach the Court which granted bail for relaxation of the conditions. Learned counsel for the petitioner would further submit that in terms of Section 6 (2)(f) of Indian Passports Act, for any person who is involved in a crime, they have to obtain permission from the Court to leave the country. 3 4. Learned Assistant Government Pleader for Home, on written instructions, would submit that two crimes have been registered against the petitioner herein. One is FIR No.26 of 2025 for the offences punishable under Sections 318(4), 351(2) r/w 3(5) of BNS on the file of II Town Police Station, Anantapur, Anantapur District, during the course of investigation, Section 5 of A.P.Protection of Depositor Act was also added and the other is Crime No.236 of 2025 registered for the offences punishable under Sections 318(4), 351(2) r/w 3(5) of BNS of Koduru P.S., of Annamaiah District. 5. Considering the submissions made, since, the petitioner is seeking permission to leave the country, it is apposite to dispose of the present petition giving him liberty to file such application before the concerned Magistrate Court and on filing such application, learned Magistrate is directed to decide the petition on its own merits and take appropriate decision according to law as expeditiously as possible. 6. With these observations, this Writ Petition is disposed of. There shall be no order as to costs.
