1. The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 115/2025, registered at Police Station – Shankargarh, District – Balrampur-Ramanujganj (C.G.) for alleged commission of o;ence punishable under Sections 318(2), 318(4), 338, 336(3), 340(2) and 61(2) of BNS. 2. As per the prosecution story in brief, is that the applicant, along with other co-accused persons, entered into a criminal conspiracy with the object of obtaining appointment on the post of Anganwadi Sahayika under the Shankargarh Block by forging false educational documents. On 21.08.2025, complainant Babli Yadav, In-charge Project O(cer, Integrated Child Development Project, Kusmi, lodged a written report at Police Station Shankargarh, stating that certain candidates had RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI
2 submitted forged mark sheets for securing their appointments. During veri>cation, it was revealed that the class 8th mark sheets purportedly issued from Ajiji Public School, Bhagwatpur/Kusmi were annexed with the applications of candidates namely, Armana, Rizwana, Priyanka, and Sushila. On scrutiny, the said documents were found to be forged and fabricated. The investigation further disclosed that the accused persons, namely Samsuddin, Abid, and Sahina, were instrumental in preparing these forged mark sheets. The appointments of the above candidates were thus procured on the strength of such forged documents and the present applicant, in the preparation and use of forged mark sheets and thereby facilitated illegal appointments. 3. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the other co-accused persons have been enlarged on bail by the learned trial Court. Therefore applicant is entitle for grant of bail. 4.
On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that the present case involves a serious o;ence of criminal conspiracy and forgery of public documents with the intent to fraudulently secure government appointments on the post of Anganwadi Sahayika under the Shankargarh Block. It is submitted that during investigation, it was found that the applicant, in collusion with other co-accused persons, had forged educational mark sheets purportedly issued from Ajiji Public School, Bhagwatpur/Kusmi, and used them to facilitate the selection and appointment of certain candidates. The co-accused persons, namely Samsuddin, Abid, and Sahina, have been found to be instrumental in the preparation of these fabricated mark sheets. The act of the applicant not only amounts to
3 cheating and forgery but also strikes at the integrity of the government recruitment process. Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the facts and circumstances of the case, and the nature of allegations indicating that the applicant, in active connivance with co-accused persons, entered into a criminal conspiracy to obtain government employment by forging educational mark sheets and using fabricated documents, the o;ence alleged is grave and strikes at the sanctity of the public recruitment system. The evidence collected so far reveals the applicant’s complicity in the preparation and use of forged marksheets, thereby facilitating illegal appointments. Considering the seriousness of the o;ence, the fraudulent intention behind the act, and the necessity of custodial interrogation for e;ective investigation, this Court is of the opinion that the applicant is not entitled to be granted anticipatory bail in this case. 7.
Accordingly, the Anticipatory Bail application of the applicant – Vishnu Yadav, >led under Section 482 of the BNSS, 2023 in connection with Crime No. 115/2025, registered at Police Station – Shankargarh, District – Balrampur-Ramanujganj (C.G.) for alleged commission of o;ence punishable under Sections 318(2), 318(4), 338, 336(3), 340(2) and 61(2) of BNS, is rejected.
