1. Impugned in this petition is an interlocutory order dated 03.09.2025, passed by the Central Administrative Tribunal (“the Tribunal”) in O.A. No. 1399/2025, titled “Gurmeet Raj v. Health and Medical Education Department”, whereby, the Tribunal has declined the interim relief prayed for by the petitioner in the O.A.
2. Having heard Mr. Pawan K. Kundal, learned counsel appearing for the petitioner and perused the order impugned, we are of the considered opinion that the impugned order does not call for any interference. However, we find that the application for interim relief has been decided by the Tribunal without inviting objections from the other side, more particularly when the vires of the rules was under challenge in the O.A.
3. In view of the aforesaid, this petition is disposed of with the direction to the Tribunal to reconsider the application of the petitioner for grant of interim relief after the reply is filed by the respondents.
4. Disposed of accordingly.
