Kishore Kumar, representing Sri P.V.Ramana, learned counsel for the petitioner(s) and Sri Talluri Ramesh Babu, learned Standing Counsel for Sri Venkateswara University, appearing for the respondents. 2. As the issues involved in all the cases are one and the same, it is deemed appropriate to dispose of the cases by way of a 8Common Order9. 3. The Writ Petitions are filed challenging action of the respondents in not releasing the commuted value of respective pensions and pension arrears to the petitioner(s). The facts as obtaining in the case of Prof. N Yashodamma, are taken as lead case for adjudication. 4. It is contended that the petitioner was working as a professor at the 3rd respondent university. On 30.06.2020, the petitioner attained the age 17 of superannuation. Vide proceedings dated 19.12.2020, the retirement benefits were fixed and the commuted value of the pension was Rs..37,12,588/-. However, the respondents failed to pay the commutation value of their pension, amounting to Rs. 37,12,588/-. It is further contended that the respondents are required to release the retirement benefits within three months of the date of retirement. On account of their failure, the petitioner(s) have made several representations. Being unsuccessful in getting the grievance resolved, the petitioner(s) have approached this Court by way of the present Writ Petitions. 6. When the matter was taken up for consideration, the learned counsel appearing for the petitioner(s) had stated that pursuant to the directions of this Court in W.P. No.26636 of 2022 dated 28.09.2022, the respondents had paid the commutation value of the pension amount on 03.03.2023. The relief sought in the Writ Petition to the relevant extent has not been pressed. However, the petitioner(s) contend that the Writ Petition is maintainable as regards the claim of the petitioner(s) for payment of the interest at 12% per annum from the date of the amount due to the date of realization. The petitioner contends that since the respondents have failed to disburse the amounts within a stipulated period, the petitioner, being a retired person, had to face hardships, having regard to the withholding of hard earned money, and was deprived of using the same for his personal purposes. Thus prays for the grant of interest in respect of his contention. 18 7. The learned counsel for the petitioners(s) in support of his contention relies on the following judgments: i. The decision of the Hon9ble Apex Court in the case of Dr. Poornima Advani & another Vs. Government of NCT & another1, ii. The Division Bench decision of the Allahabad High Court in the case of Shiv Shankar Mishra Vs. State of U.P. & Others. iii. The Division Bench decision of this Court in W.A.Nos.952, 1000 of 2022 and 26 of 2023 dated 11.08.2023. 8. The respondents have filed a counter affidavit stating that, in terms of the interim orders passed by this Court, the respondents have paid the commutation value of the pension on 03.03.2023, along with other arrears. The delay in remission of the amount was pleaded as an administrative reason for the delay in payment. 9. The commuted value of pension granted to the petitioner (in the case of N.Yasodamaa in W.P.No.26636 of 2022) is as follows: “4. COMMUTED VALUE OF PENSION:- Rs.37,12,588/- (Rupees Thirty Seven Lakh Twelve Thousand Five Hundred and Eighty Eight only) is payable subject to a recovery of Rs.38,760/- (Rupees Thirty Eight Thousand Seven Hundred and Sixty only) per month towards Commuted Portion of Pension from the Superannuation Pension of Rs.96,900/- for a period of 15 years from the date of effecting payment.” 1 2025 INSI 262 19 10. Nothing has been brought to record regarding relevant rules governing the grant of interest on the delayed payment of commuted pension. 11. At this juncture, it is very relevant to refer to the clarification issued by the Government of India, Ministry of Personnel, P.G. and Pensions through O.M.No.42/15/2022-P&PW(D)/7 dated 31.10.2022, which reads as under: “No.42/15/2022-P&PW(D)/7 Government of India Ministry of Personnel, P.G. & Pensions Department of Pension & Pensioners’ Welfare OFFICE MEMORANDUM 1…….. 2…….. 3. It is clarified that in accordance with Rule 6 of the CCS (Commutation of Pension) Rules, 1981, in cases where the commuted value of pension is paid after retirement, the reduction of the amount of commuted pension from the monthly pension becomes operative from the date on which the Commuted value of pension is paid. As per Rule 10A of CCS(Commutation of Pension) Rules, the commuted amount of the pension is restored on completion of fifteen years from the date the reduction of pension on account of commutation becomes operative in accordance with Rule 6. Since the pensioner continues to receive full pension till the date of payment of commuted value of pension, the question of payment of any interest on delayed payment of commutation of pension does not arise.” 12. Even assuming that the said clarification issued by the Government of India, would not apply to the case of the petitioner. However, applying the same analogy, and the reasoning to the facts of the case, this Court is of the view that the petitioner(s) is not entitled to claim interest for the delay in payment of commuted value of pension. Even as per the proceedings 20 of the University, the commuted value of pension paid in lump sum is subject to recovery of certain sum per month from superannuation pension for a period of 15 years from the date of effecting the payments, therefore claim for granting interest on account of delay in payment of commuted value of pension would not merit consideration. The judgments relied upon by the petitioner(s) are distinguishable on facts and they are not on the issue that has been raised in the case. 13. With the above observations, the Writ Petitions are dismissed. There shall be no order as to costs.
