ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.10 on bail in Crime No.190 of 2025 of Bhogapuram Police Station, Vizianagaram District, was registered against the Petitioner/Accused No.10 herein for the offences punishable under Section 20(b)(ii)(C) read with Section 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2
2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. The petitioner is shown as Accused No.10 in Crime No.190 of 2025 of Bhogapuram Police Station, Vizianagaram District. She was arrested on 24.07.2025 on the allegation that she was in possession of 42.235 grams of ganja. As seen from the record, the petitioner was travelling in a car driven by her husband, who is arrayed as Accused No.9. The petitioner is aged about 34 years and is carrying 11 weeks of pregnancy. She has a two-year-old son who is suffering from an illness. The petitioner herself is also suffering from ill health. So far, eight (8) witnesses have been examined. The medical certificate indicate that the petitioner was 11 weeks pregnant as on
29.09.2025. 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.10, this Court is inclined to enlarge the Petitioner/Accused No.10 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.10 shall be enlarged on bail subject to she executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for the like sum each to the satisfaction of the learned Principle Junior Civil Judge-cum-Judicial First Class Magistrate, Vizianagaram. 3
ii. The Petitioner/Accused No.10 shall not commit or indulge in commission of any offence in future. _________________________ DR.
