GP FOR PANCHAYAT RAJ RURAL DEV 3 The Court made the following Order : Non-consideration of the petitioner’s compliant dated 17.11.2025, requesting the respondent Gram Panchayt concerned to take action against the 5th respondent who is constructing the Poultry Farm within the residential area of Kommaripalem Village, Biccavolu Mandal, East Godavari District, the present writ petition is filed. 2. Heard Sri P.R.K. Amrendra Kumar, learned counsel for the petitioner, Sri Y. Koteswara Rao, learned Standing Counsel for the Gram Panchayat and Ms. Naga Chandrika, learned Assistant Government Pleader for Panchayat Raj. 3. Learned counsel for the petitioner, while reiterating the contents of the affidavit, submitted that the petitioner along with others submitted a complaint dated 17.11.2025 to the concerned Gram Panchayat against the illegal construction of Poultry Farm in the middle of the village by the 5th respondent. Despite the said complaint, no action has been initiated. He further submitted that it would suffice for the time being if a direction is given to the 4 authority concerned to act upon the petitioner’s grievance in accordance with law. 4. Learned Standing Counsel, on written instruction dated 06.12.2025, submitted that except for the erection of sheds, no other construction has been made by the 5th respondent, as alleged by the petitioner in the writ petition. Even for the erection of such sheds, the 5th respondent did not obtain any approved plan. He further submitted that the Gram Panchayat would look into the issue and take steps in accordance with law. In fact, a notice has already been issued to the 5th respondent and further action will be taken in accordance with law. As such, prayed to close the writ petition. 5. As could be culled out from the submissions and written instructions dated 06.12.2025, submitted by the learned Standing Counsel, the Gram Panchayat concerned has already set the law into motion, as such, there is no purpose in keeping the writ petition pending inviting counter affidavit. As no positive orders are being passed affecting the rights of the 5th respondent, issuance of notice to him is hereby dispensed with. As such, this 5 Court is inclined to dispose of the writ petition by passing the following order: <The Respondent Gram Panchayat concerned shall look into the grievance of the petitioner so made in the complaint dated 17.11.2025 and if found any construction without approved building plan, shall take steps in accordance with law by issuing proper notices to the concerned parties, inviting explanation and pass a reasoned order in accordance with law, as expeditiously as possible.= 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
