[2025:RJ-JP:6350] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 1215/2025 Karan Dhanka S/o Bachchan Singh, Aged About 21 Years, R/o Raiyo Ka Bas, Police Station Patan, District Neem Ka Thana (Raj.) (At Present Accused Petitioner Confined In Kotputli Jail). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Surendar Meel, Mr. Aryan Verma For Respondent(s) : Mr. S.R. Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 13/02/2025 1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.516/2024 registered at Police Station Pragpura, District Kotputli-Behror for the offence punishable under Section 305(a) and 331(2) of BNS, 2023. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Learned counsel submits that alleged offences are triable by Magistrate. He further submits that the other co-accused has already been granted benefit of bail by the learned trial Court. It is also contended that charge-sheet has already been produced before the concerned Court and trial of the case will take [2025:RJ-JP:6350] (2 of 3) [CRLMB-1215/2025] considerable time. The petitioner is in custody since long, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application. 4. Heard and perused the material available on record. 5. Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner, especially the fact that alleged offences are triable by Magistrate, charge-sheet has already been before the concerned Court and trial of the case will take considerable time, the accused-petitioner is in custody since long, without commenting further anything on the merits/demerits of the case, I deem it just and proper to allow the bail application. 6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Karan Dhanka S/o Bachchan Singh, in connection with FIR No.516/2024 registered at Police Station Pragpura, District Kotputli-Behror, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. 7. The accused is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner to the trial court every [2025:RJ-JP:6350] (3 of 3) [CRLMB-1215/2025] month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Magistrate.
