Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as accused Crime No.363 of 2024 of Nuzvid Rural Police Station, Eluru District, registered for the alleged offence under Sections 120B, 153A, 505, 419, 354A of the Indian Penal Code, 1860, Section 67A of the Information Technology Act, 2000- 2008, Sections 3(2)(va), 3(1)(w)(ii) SC & ST (POA) Amendment Act, 2015 on the strength of the complaint of the 3'"' respondent. 3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the complaint solely on the confession of the other accused. It is alleged in the complaint that the petitioner posted abusive content on the social media platform, i.e., Facebook, against political leaders. The learned counsel further submits that the offences alleged against the petitioner are punishable by imprisonment of less than 7 years and, therefore, seeks a direction to the police to follow the procedure provided under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. 4. Considering the submissions of the learned counsel for the petitioner, the Station House Officer, Nuzvid Rural Police Station, Eluru District, is directed to follow the procedure as contemplated under Section 35(3) of 3 CRLP. No.3280 of 2025 as the petitioner is concerned, for the purpose of investigation in connection with Crime No.363 of 2024. 5. Accordingly, the criminal petition is disposed off. 6.
