THE HON’BLE SRI JUSTICE HARINATH.N WRIT PETITION No.25548 OF 2025 ORDER:
1. This writ petition is filed aggrieved by the issuance of the survey report, dated 14.08.2025, whereby the 2nd respondent identified the land in Survey No.710, Mydukuru Municipality, Mydukuru Town, YSR Kadapa District, belongs to the 10th respondent. 2. Heard the submissions of the learned counsel for the petitioner and the learned Government Pleader for Municipal Administration & Urban Development, appearing for respondent No.1, the learned standing counsel for the Corporation, appearing for respondents 2 and 3, the learned Government Pleader for Revenue for Revenue, appearing for respondents 4 and 5, the learned Government Pleader for Stamps & Registration, appearing for respondents 6 & 7. 3. The learned counsel for the petitioner submits that the petitioner had purchased the said property under a registered sale deed dated 01.03.2014 and that the vendor of the petitioner had purchased the property on 27.04.1979. It is further submitted that based on the survey report, the 10th respondent has executed a sale deed dated 21.08.2025 in favour of the 8th respondent. It is also submitted that the sale deed executed by the 10th respondent in favour of the 8th respondent is a sham transaction, the basis of which is the survey report issued by the

2nd respondent, without providing notice to the petitioner. In this regard, the petitioner submitted a representation dated 01.09.2025 to the 4th respondent. The learned counsel further submits that the 4th respondent is required to adjudicate the grievance of the petitioner in terms of the amendment to the Registration Act, whereby Section 77-A has been incorporated, making it obligatory for the 4th respondent to decide such an issue. 4.
On the other hand, the learned Standing Counsel for respondents 2 and 3, on written instructions, submits that the survey report does not confer any title, as is also clearly stated in the note of the survey report. It merely indicates the survey number of the property. It is also submitted that the execution of the sale deed by the 10th respondent in favour of the 8th respondent is a matter that the petitioner would have to agitate before the appropriate civil court by seeking cancellation of the sale deed. 5. The petitioner is seeking only a direction to the 4th respondent to consider his representation dated 01.09.2025, by which the petitioner brought to the notice to the 4th respondent that the document registered in favour of the 8th respondent is without any basis and also without any link document and that the 10th respondent has relied on the survey report for executing the said document. 6. Considering the submissions made by both the learned counsel, this Court is of the considered opinion that the writ petition can be disposed

of at the admission stage, dispensing with notice to the unofficial respondents, by directing the 4th respondent to consider and dispose of the representation of the petitioner in accordance with law, and after issuing due notice to all concerned parties. The 4th respondent shall undertake such consideration and pass a reasoned order within a period of eight weeks from the date of receipt of this order. 7. Accordingly, the writ petition is disposed of. No costs. 8. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ___________________ JUSTICE HARINATH.N BV
