Heard learned Advocate for the appellant. The respondent is absent.

I have heard learned Advocate for the appellant/applicant. Learned Advocate took me through the application for condonation of delay. It is pointed out that the reasons stated in the application are sufficient to condone 189 days delay in filing the appeal.

On going through the application I am satisfied that a case is made out for condonation of delay. I do not find any reason to disbelieve the facts stated in the application.

In view of this the application is allowed. 189 days delay in filing the appeal against the order of 2025:BHC-NAG:1444
2 34 appa 321.24.odt..odt acquittal dated 27.06.2023 passed by the Chief Judicial Magistrate, Gondia in SCC No.1514/2022 is condoned.
5. The application stands disposed of.
6. Issue notice to the respondents on the prayer for leave to appeal, returnable within four weeks.
