1. Mr. Ajaz Chowdhary, learned counsel appearing for the petitioners submits that as per status report filed by respondent No. 1, complicity of petitioner No. 2 in commission of offences has not been established. He further submits that the present petition be disposed of by permitting the other petitioners to put forth their case before the Investigating Officer and the Investigating Officer be directed to consider their case in accordance with law.
2. In view of the above, the present petition is dismissed as having been rendered infructuous qua petitioner No. 2. So far as other petitioners are concerned, they shall be at liberty to project their grievance before the Investigating Officer and in the event any defence/claim is projected by the other petitioners other than petitioner No. 2, the same Serial No. 67

shall be considered by the Investigating Officer in accordance with law. Investigating Officer shall also file the closure report against petitioner No. 2.
