Heard Mr. Pawan Kesharwani, learned counsel for the petitioner. Also heard Mr. Hariom Rai, learned Panel Lawyer, appearing for respondent / State. 2. The petitioner has filed this petition praying for following relief:- MANPREET KAUR Digitally signed by MANPREET KAUR Date: 2025.01.24 17:46:46 +0530 2 “i. May this Hon'ble Court be kind enough to call for the entire records pertaining to the case of the Petitioner. ii. May this Hon'ble Court be kind enough to quash the F.I.R. bearing Crime No. 478/2024 dated 26.09.2024 registered against the Petitioner under Section 69 of the Bhartiya Nyaya Sanhita, 2023 and the further proceedings arising out of the same. iii. May this Hon'ble Court be kind enough to grant Any other relief which the Hon'ble Court may deem fit in the facts and circumstances of the case.” 3. From perusal of the present petition, it transpires that though the charge-sheet has been annexed, but the same has not been challenged. Further, order taking cognizance has also not been challenged. The learned counsel for the petitioner states that he has challenged further proceedings in pursuance to the FIR dated 26.09.2024 bearing Crime No. 478/2024. 4. But, perusal of the records shows that charge-sheet has already been encroached and without making any prayer for quashing of the same, the learned counsel for the petitioner has drafted a vague and sketchy prayer. 5. Learned counsel for the petitioner prays to withdraw the petition with the liberty to file a duly constituted petition with an appropriate prayer. 6. Accordingly, this petition is dismissed as withdrawn, with liberty to file petition afresh with appropriate prayer and pleadings, subject to depositing a sum of Rs.2,000/- as cost by the petitioner in the Registry of this Court within a period of one week from 3 today, and the same shall be transmitted to the Government School for Visual and Hearing Impaired, Tifra, District - Bilaspur (C.G.). 7. Learned Panel Lawyer appearing for respondent / State is present. 8. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same, subject to deposit of the fine amount.
