It is contended by counsel for respondent no.2 that during pendency of the present C482 application, respondent no.2 has expired on 19.02.2024. 5. On the above fact, the C482 application would render infructuous, but it is contended by learned counsel for the applicant that cognizance was taken and the matter was committed against four accused persons including respondent no.2, however, since then, three persons have not challenged the said order in a revision petition. 6. The statement made by learned counsel for the applicant is wrong as from the record it is reflected that all the four persons have challenged the order in Revision Petition No.3 of 2023 before learned Sessions Judge, Nainital. But the other respondents appear to be satisfied with the order since they have not challenged the same as the order have attained finality with respect to other three persons. 7. In view of the fact that the fourth one who has been impleaded as party respondent no.2 expired, the C482 application has rendered infructuous. 8. Accordingly the same is rendered as infructuous.
